GENERAL TERMS AND CONDITIONS OF SALE

Article 1

These general terms and conditions of sale apply to all orders placed on the website “www.AydaCosmetics.com.”

The applicable General Terms and Conditions of Sale (GTC) are those in effect on the day the order is confirmed.

Article 2

The buyer acknowledges having read the general terms and conditions of sale clearly stated by Ayda SAS for its website: “www.AydaCosmetics.com” and accepts them without reservation at the time of placing an order.

These general terms and conditions of sale take precedence over any other conditions appearing in any other document, except for prior, express, and written derogation. The seller is defined below as the company Ayda SAS via “www.AydaCosmetics.com,” with its registered office at 7 rue de Montespan, 91000 Evry (France), reachable at the following phone number: 00 33 1 69 47 60 47.

The company Ayda is under the legal status of a Simplified Joint Stock Company, and the buyer is defined below as the company or the person signing and accepting these sales conditions. The buyer declares having the legal capacity to contract under the conditions described below, meaning having reached the legal age of majority and not being under guardianship or curatorship. Before placing an order, the buyer acknowledges having read the present General Terms and Conditions of Sale.

Article 3

Any order for a product offered on the website implies the consultation and the express acceptance of these general terms and conditions of sale, without this acceptance being subject to a handwritten signature by the user. In accordance with the provisions of articles 1316 to 1316-4 of the French Civil Code, supplemented by Decree No. 2001-272 of March 30, 2001, adopted for the application of article 1316-4 of the French Civil Code and concerning electronic signatures, it is reminded that the validation of the order form, as specified in article 2, constitutes an electronic signature that has, between the parties, the same value as a handwritten signature.

Article 4

On our online store “www.AydaCosmetics.com,” prices are always indicated in Euros, including all taxes (VAT), with the only additional charge being the shipping cost for the buyer if the invoice amount does not reach the threshold for free shipping. The conversion into foreign currency is given for information purposes only and is not contractual. Only the price in euros is guaranteed. If this currency is different from that viewed by the customer, any potential charges will be borne by the customer.

Article 5

The buyer has a withdrawal and refund period of fourteen (14) days from the date of receipt of the products by the Customer to return any product that does not suit them. The buyer can either exchange all or part of their order or request a refund, provided that the returned products are in perfect condition. The return can be made to the following address: Ayda – 7 rue de Montespan – 91000 Evry Cedex (France).

Ayda will refund the Customer the full amount paid (including delivery charges) using the same payment method as that used by the Customer for the initial transaction, unless the Customer expressly agrees to Ayda using another payment method, and provided that the refund does not incur any costs for the Customer.

Article 6

Ayda will deliver to the address provided by the buyer in their order. If the buyer provides an incorrect or incomplete address, they will be responsible for the impossibility of delivering the order. If your package is returned to us due to an incorrect or incomplete address, the re-shipping costs will be at your expense, regardless of the amount of your order, based on the prevailing rate of your country code.

Any delay in delivery (see delivery times at www.aydacosmetics.com/suivi-de-vos-livraisons/) entitles the Customer to terminate the contract in accordance with the procedure described in L.216-2 of the French Consumer Code.

Upon receipt of their delivery, the buyer must check the condition of the package and, if necessary, must make reservations with the carrier or refuse the delivery.

Force majeure events relieving Ayda SAS of its obligation to deliver include war, riots, fires, and strikes.

Products travel at Ayda’s risk and peril. Any risk of loss or damage to the products is transferred to the Customer when the latter or a third party designated by them, other than the carrier offered by Ayda, physically takes possession of the goods.

Claims regarding product quality must be made within 8 days of receiving the delivery.

Article 7

In the case of temporary unavailability, Ayda will inform the buyer by email, who will have one working week (excluding weekends and holidays) to request the cancellation or exchange of their order by contacting our customer service by email at the following address: service-client@aydacosmetics.com. Ayda SAS reserves an additional week for order processing.

If a product becomes permanently unavailable after the order is placed, the buyer will be informed in the same way by email or phone about the items that are permanently out of stock.

If no request is received from the buyer after this period, the order will then be shipped with the available items only, and only these items will be invoiced.

In case of non-delivery by the expiration of the specified deadlines on the page mentioned above, the buyer will have the option to cancel the order. The amounts paid by the buyer will be refunded without delay, with no additional compensation. In case of a delivery delay compared to the initially set date, the buyer must report it in writing (by mail or email) to Ayda in order to improve the quality of service that can be offered and to allow Ayda SAS to conduct an investigation with the carrier.

Article 8

Payments can be made by credit card.

Orders become final upon receipt of payment.

Article 9

Ayda undertakes not to disclose the confidential information provided by buyers and visitors to its site. This information will only be used for order processing.

This article does not prevent the assignment or transfer of activities to a third party.

In accordance with the French Data Protection Act of January 6, 1978, the buyer has a right of access, rectification, and opposition to personal data concerning them.

To exercise this right, simply send an email or letter indicating the email address, name, first name, and address.

Article 10

All elements of the website www.aydacosmetics.com are the intellectual and exclusive property of Ayda SAS. No one is authorized to reproduce, exploit, redistribute, or use, in any capacity, even partially, any elements of the website, whether they are software, visual, or auditory.

Article 11

In the event of a complaint, the User and/or Customer can contact Ayda’s Customer Service (service-client@aydacosmetics.com), which will endeavor to find an amicable solution to the dispute.

In case of failure of this process and in case of a dispute, the Customer can use the free mediation service of the MEDICYS Mediation Center, to which Ayda SAS belongs, by mail at: MEDICYS – 73 Boulevard de Clichy – 75009 PARIS.

In the event of failure, the Commercial Court of Evry shall be the sole competent court by express agreement.
